Who can serve documents in Prince Edward Island
Requirements depend on the court and document
Prince Edward Island’s Rules of Civil Procedure explain how personal service is effected but do not establish a general qualification rule for every server. A specific exception applies to divorce: the petitioner must not personally serve their own petition. PEI Rules of Civil Procedure, Rules 16 and 70.04(4).
Accepted methods of service
Methods depend on the court, document and any order
An originating process is generally served personally; Rule 16.03 provides alternatives where the Rules or a court order permit them. For a divorce petition, Rule 70.04(1) expressly allows personal service or the specific methods in Rule 16.03(2)–(4), including lawyer acceptance and mail with signed acknowledgment. Other Rule 16.03 methods, such as residential drop-and-mail after an unsuccessful attempt, do not apply to a divorce petition. A court may order substituted service or dispense with service where the rule’s test is met. PEI Rules of Civil Procedure, Rules 16.01–16.04 · PEI Rule 70, rule 70.04(1).
Later documents generally follow separate delivery rules. PEI Rules of Civil Procedure, Rules 16.05–16.09.
Time limits and rules for serving
There is no single service clock for every PEI document. A divorce petition must be served within six months after issue unless the court extends the time. PEI Rule 70.05.
For Small Claims, a Statement of Claim must be served within six months after issue, subject to extension. A defendant served in PEI generally has 20 days to file a defence; service elsewhere has a 40-day period. 2026 Small Claims Rules, Rules 8.01 and 9.01. These examples are specific to their proceedings.
Restrictions on serving
Court- and document-specific limits
For a divorce petition, Rule 70.04(1) permits personal service or only the listed methods in Rule 16.03(2)–(4); do not assume the other Rule 16.03 alternatives apply. If personal service is chosen, someone other than the petitioner must serve it. PEI Rule 70, rules 70.04(1) and 70.04(4).
Small Claims has its own Rule 74 procedure; do not assume that every Supreme Court civil rule applies unchanged. 2026 Small Claims Rules, Rule 74.
Proof of service and affidavit requirements
For general civil service, Rule 16 provides an affidavit of service (Form 16B); a sheriff or sheriff’s officer may use a certificate of service (Form 16C) in specified circumstances. PEI Rules of Civil Procedure, Rule 16.09.
Small Claims uses an affidavit of service, Form 8B. 2026 Small Claims Rules, Rule 8.06. This is general information, not legal advice; confirm the correct proof form for your proceeding.
