This version has not yet been reviewed by a lawyer.

This Privacy Policy explains what personal information Canadian Process Server (“Canadian Process Server,” “CPS,” “we,” “us” or “our”) collects when you use our website and platform, why we collect it, who we share it with and the choices you have. Canadian Process Server is a service of Court Runner Inc., based in Toronto, Ontario. We handle personal information in line with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). You may reach us at info@canadianprocesssserver.ca.

Who this policy covers

Canadian Process Server is an online platform for ordering service of legal documents at addresses in Canada. This policy applies to:

  • Clients who create an account and order service of legal documents.
  • Process servers who apply to join the platform and complete jobs.
  • People and businesses being served, whose details clients give us so the documents can be delivered.
  • Visitors who browse our website.

Who is responsible for your information

Court Runner Inc. is responsible for the personal information it holds, including information that our service providers handle for us. Questions, requests and complaints about your personal information go to our privacy contact at info@canadianprocesssserver.ca (see Contact us for our phone number and mailing address).

Information we collect

From clients

  • Account and contact details: your name, company or law firm (optional), email address, phone number, billing address and sign-in credentials.
  • Details about the person or entity to be served: name, entity type, and, if you choose to give them, a physical description, date of birth and photo.
  • Service details: the service address or addresses, the best times to attempt service and any special instructions.
  • Court and case information: the province, the court, the court file number, the style of cause, plus the document type, the service type and your deadline.
  • Documents: the PDF files you upload for service.
  • Mobile number and text message consent (optional): if you opt in to text messages, your mobile number, the date and time you agreed, the wording you agreed to and, if you opt out, when you did.
  • Payment information: card payments are processed by Stripe, which collects and holds your card details. Canadian Process Server does not store full card numbers. We keep a record of each payment: the amount, the GST/HST charged, the date and the status.

From process servers

  • Contact and business details: your name, business name, email address, phone number and address.
  • Service area and experience: the provinces and cities you serve, your service radius and your experience.
  • Verification information: a copy of your government-issued photo ID and, where you have them, your licence or registration number and your insurance information.
  • Payout information: payouts are handled through Stripe, which collects the details it needs to verify your identity and pay you into your Canadian bank account. We do not see your bank account number.
  • Mobile number and text message consent (optional): if you opt in to text messages, your mobile number, the date and time you agreed, the wording you agreed to and, if you opt out, when you did.

Recorded while a job is in progress

For each service attempt, the process server records the time, their GPS location, photos and notes. When service is complete, an affidavit of service is prepared from the job record, sworn or affirmed before a commissioner for taking affidavits or a notary public, and uploaded. See Location data and photos below.

Collected automatically

When you sign in, we set cookies that keep you signed in. Like any website, our servers may also receive basic technical information your browser sends with each request, such as your IP address and browser type.

When you accept our Terms of Service or, as a process server, our Independent Contractor Agreement, we keep a record of which version you accepted, when you accepted it, and the IP address and browser your acceptance came from.

Why we collect and use information

We use personal information to:

  • create and manage accounts and verify who you are;
  • show your price, match your job with a process server near the service address, and let that server attempt service;
  • record each attempt and prepare, sign and deliver the affidavit of service;
  • process client payments, charge GST/HST and pay process servers through Stripe;
  • send email notifications when the status of a job changes;
  • send text messages about your jobs and account, and one-time verification codes, if you opt in;
  • review process server applications, including ID, licence or registration and insurance where a server has them, before a server is approved;
  • answer questions and requests you send us through our contact page;
  • protect the platform, our users and the people being served against fraud, misuse and security threats; and
  • meet our legal obligations and enforce our Terms of Service.

We do not use personal information for anything else without asking you first.

We collect, use and share personal information with your knowledge and consent, except where the law allows or requires otherwise. By creating an account, submitting a request, applying as a process server or accepting our Terms of Service, you agree to the collection, use and sharing described in this policy. You can withdraw your consent at any time by contacting us, subject to legal and contractual limits. If you withdraw it, we may no longer be able to provide the service.

Clients give us information about the people they want served, and confirm that they have the right to do so. See People and businesses being served.

How we share information

We share personal information only as described here.

  • With the assigned process server. After a client has paid for a job, the process server assigned to it can see what is needed to attempt service: the documents, the name and details of the person or entity to be served, the service address, the best times, special instructions and the court information. A client’s phone number and email address are never shared with process servers. There is no direct communication channel between clients and servers on the platform; Canadian Process Server coordinates the job.
  • With the client who ordered the job. The client sees the process server’s attempt records for their job (time, GPS location, photos and notes) and receives the sworn affidavit, which identifies the process server who swore or affirmed it.
  • With Canadian Process Server administrators. Our admins can access a job’s documents and service details to run the platform, review process servers, resolve problems and answer requests.
  • With service providers. We use providers that work for us: payment processing (Stripe), email delivery, text message delivery, an artificial intelligence service that reads uploaded documents, address and distance look-ups, and hosting. They may use the information only to provide those services to us, and we share only what each one needs.
  • When required by law. We may disclose information to comply with a law, subpoena, court order or other legal process, or when we believe in good faith that disclosure is needed to protect the rights, property or safety of Canadian Process Server, our users or others.

Affidavits are prepared so they can be filed with a court. Once a client files an affidavit, it may become part of the court record.

We do not sell personal information.

Where your information is processed

Our company is in Canada, but some of our service providers, including those for payments, email, text messages, address look-ups and the AI document reader, are based or process information outside Canada, including in the United States. Information that is processed in another country is subject to that country’s laws, and its courts, law enforcement and national security authorities may be able to access it. If you have questions about this, contact us.

Automated document processing

Documents you upload may be processed by a third-party AI service provider acting on our behalf, only to extract the information needed to prepare your service request. We share only what is necessary for this purpose. The company that runs the AI model does not use your documents to train its models and deletes them from its systems within 30 days, except where the law requires longer retention or to prevent abuse. Documents may be processed outside Canada. Your documents are stored securely and are shared with the process server assigned to your job. You can ask us how your documents were processed by contacting us.

SMS / Text messages

If you opt in, we send text messages about your jobs and account only. Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for help. We do not sell or share mobile numbers or SMS opt-in consent with third parties or affiliates for marketing purposes.

We send text messages only with your express consent, which we record. You can withdraw it at any time by replying STOP or in your account settings.

Location data and photos

Process servers record their GPS location, a time stamp and photos for each service attempt. This creates a verifiable record of when and where each attempt took place, and it is used to prepare the affidavit of service.

Attempt photos may show the service address, its surroundings or, where service is completed in person, the person served. Location and photos are recorded when a server logs an attempt on a job. They are available only to the client who ordered that job, the assigned process server and Canadian Process Server administrators, unless disclosure is required by law.

People and businesses being served

If you are being served with legal documents through Canadian Process Server, we received your information from the client who ordered service, not from you. That may include your name, address, the type of entity, and any description, date of birth or photo the client chose to give. We use it only to complete service, record the attempts and prepare the affidavit of service, and we share it only as described in this policy. You can ask us what information we hold about you, and ask us to correct it, through our contact page.

Cookies and similar technologies

We use cookies that are needed to sign you in and keep your session secure. If you block these cookies in your browser, you will not be able to sign in. We do not use cookies for advertising, and we do not use analytics or tracking tools on our pages.

We load Stripe’s script on every page so that Stripe can help us detect fraud and card testing. It may collect device and browser information, which Stripe handles under its own privacy policy.

How we protect information

Documents and personal information are stored privately and are never placed on public links. Only the process server assigned to a job (after payment) and Canadian Process Server administrators can access that job’s documents and service details. Information travels over encrypted connections. Card numbers are handled by Stripe, and Canadian Process Server does not store full card numbers.

No method of storing or sending information is completely secure, so we cannot guarantee absolute security. Please keep your password confidential and tell us through our contact page if you believe your account has been accessed without your permission.

Privacy breaches

If a breach of our security safeguards involving your personal information creates a real risk of significant harm to you, we will tell you and report it to the Office of the Privacy Commissioner of Canada, as PIPEDA requires. We keep a record of every breach of security safeguards.

How long we keep information

We do not currently delete information automatically after a fixed number of years. We keep personal information for as long as it is needed to provide the service, handle problems and disputes, and meet our legal, tax and accounting obligations. That includes records of completed jobs, payments, affidavits and the versions of our terms you accepted. When we no longer need information for those purposes, we delete it or keep it in a form that no longer identifies you. If you ask us to delete your information, we do so unless we need to keep it for one of those reasons, and we tell you what we kept and why.

Your choices and rights

  • Access, correction and deletion. You can ask us for a copy of your personal information, to correct or update it, or to delete it by contacting us through our contact page. We will respond within 30 days. If we cannot give you access to something, or need to keep information, we will tell you why.
  • Challenging how we handle your information. You can ask us how we handle your personal information, and challenge our answer.
  • Email notifications. Status update emails are part of the service. They tell you about jobs you ordered or accepted.
  • Text messages. Text messages are optional and are sent only if you opt in, after you confirm your number with a one-time code. Reply STOP to any message to opt out, or HELP for help. You can also turn them off at any time in your account settings.

We will verify your identity before acting on a request, to protect your information.

Complaints

If you have a concern about how we handle your personal information, contact us first, and we will look into it. If we cannot resolve it, you have the right to file a complaint with the Office of the Privacy Commissioner of Canada at priv.gc.ca.

Children

Canadian Process Server is not intended for anyone under 18. We do not knowingly allow anyone under 18 to create an account. If you believe a person under 18 has created an account, contact us and we will close it.

Changes to this policy

We may update this Privacy Policy as the service changes. When we do, we will change the “Last updated” date at the top of this page. If a change is significant, we will also tell account holders by email or with a notice on the site.
